Que faire ?<br><br>2- Vous avez re\u00e7u une lettre de d\u00e9mission mais le salari\u00e9 indique que sa d\u00e9mission a \u00e9t\u00e9 provoqu\u00e9e par un manquement de votre part. Comment r\u00e9agir ?&nbsp;<\/p>\n\n\n\n<h2 class=\"has-text-color wp-block-heading\" style=\"color:#5b5b5b\">&nbsp;Salari\u00e9(e)&nbsp;?&nbsp; Vous \u00eates confront\u00e9s \u00e0 l\u2019une de ces situations&nbsp;:<\/h2>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\">&nbsp;1\/ Vous subissez du harc\u00e8lement moral, sexuel, de la discrimination, ou vous \u00eates en burn out et vous voulez d\u00e9missionner ou vous avez d\u00e9missionn\u00e9.<br><br>2- Vous n\u2019avez pas \u00e9t\u00e9 pay\u00e9 de vos salaires, ou de vos heures suppl\u00e9mentaires, de vos primes, de vos commissions \u2026 et vous ne voulez plus continuer \u00e0 travailler.<br><br>Que faire ?<\/p>\n\n\n\n<h2 class=\"has-text-color wp-block-heading\" style=\"color:#5b5b5b\"><strong>LA PRISE D\u2019ACTE, QU\u2019EST-CE QUE C\u2019EST&nbsp;?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\">Lorsqu&rsquo;un(e) salari\u00e9(e) prend acte de la rupture de son contrat de travail en raison de faits qu&rsquo;il reproche \u00e0 son employeur, cette rupture produit les effets :<\/p>\n\n\n\n<ul class=\"has-text-color wp-block-list\" style=\"color:#5b5b5b;font-size:20px\">\n<li>Soit d&rsquo;un licenciement sans cause r\u00e9elle et s\u00e9rieuse si les faits invoqu\u00e9s justifiaient la rupture,&nbsp;<\/li>\n\n\n\n<li>Soit une d\u00e9mission, si les faits ne justifiaient pas une rupture. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\">Ainsi <em>\u00ab la prise d&rsquo;acte permet au salari\u00e9 de rompre le contrat de travail aux torts de l&#8217;employeur en cas de manquement suffisamment grave de l&#8217;employeur qui emp\u00eache la poursuite du contrat de travail<\/em>&nbsp;<strong>\u00bb.<\/strong><br><br>La Cour de cassation a consacr\u00e9 ce nouveau mode de rupture, par lequel la rupture est \u00e0 l\u2019initiative du salari\u00e9, comme la d\u00e9mission, mais peut \u00eatre imputable \u00e0 l\u2019employeur.<\/p>\n\n\n\n<h2 class=\"has-text-color wp-block-heading\" style=\"color:#5b5b5b\"><strong>IL Y A DONC UNE DIFF\u00c9RENCE ENTRE D\u00c9MISSION ET PRISE D\u2019ACTE.<\/strong><\/h2>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\">La d\u00e9mission doit r\u00e9sulter d\u2019une manifestation claire et non \u00e9quivoque de volont\u00e9 du salari\u00e9 de rompre le contrat de travail.&nbsp;<br><br>Si elle est \u00e9quivoque, ou avec r\u00e9serves, elle peut \u00eatre requalifi\u00e9e en prise d\u2019acte.<br><br>Ainsi, si le salari\u00e9 d\u00e9missionne et qu\u2019il invoque des fautes \u00e0 l\u2019encontre de son employeur, il s\u2019agit d\u2019une prise d\u2019acte.<\/p>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\"><strong>Exemple&nbsp;:<\/strong><\/p>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\">Le salari\u00e9 peut envoyer une lettre de d\u00e9mission simple puis quelques jours apr\u00e8s, faire parvenir un nouveau courrier indiquant \u00e0 l\u2019employeur que le motif de sa d\u00e9mission est justifi\u00e9 par des fautes graves de l\u2019employeur. Il s\u2019agit l\u00e0 assur\u00e9ment d\u2019une prise d\u2019acte et non pas d\u2019une d\u00e9mission.<br><br>En tout \u00e9tat de cause, la volont\u00e9 de d\u00e9missionner du salari\u00e9 doit \u00eatre \u00e9quivoque au moment o\u00f9 il rompt le contrat pour que les juges la requalifient en prise d\u2019acte.<\/p>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\"><strong>La prise d\u2019acte peut intervenir et \u00eatre jug\u00e9e comme telle dans diff\u00e9rentes situations&nbsp;<\/strong><strong>:<\/strong><\/p>\n\n\n\n<ul class=\"is-style-arrow has-text-color wp-block-list\" style=\"color:#5b5b5b;font-size:20px\">\n<li>A la suite d\u2019une d\u00e9claration d\u2019inaptitude de la m\u00e9decine du travail<\/li>\n\n\n\n<li>A la suite d\u2019un accident du travail, d\u2019une maladie<\/li>\n\n\n\n<li>Apr\u00e8s le transfert d\u2019un salari\u00e9 dans une nouvelle entit\u00e9<\/li>\n\n\n\n<li>Apr\u00e8s le d\u00e9part en retraite d\u2019un salari\u00e9<\/li>\n<\/ul>\n\n\n\n<h2 class=\"has-text-color wp-block-heading\" style=\"color:#5b5b5b\"><strong>QUELLES SONT LES CONS\u00c9QUENCES FINANCI\u00c8RES DE LA PRISE D&rsquo;ACTE PAR LE SALARI\u00c9&nbsp;?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\"><strong>Les cons\u00e9quences financi\u00e8res peuvent \u00eatre importantes pour l\u2019employeur<\/strong><br><br><strong>Si le conseil des prudhommes requalifie la prise d\u2019acte en licenciements sans cause r\u00e9elle et s\u00e9rieuse,<\/strong>&nbsp;<strong>la prise d&rsquo;acte produira les effets d&rsquo;un licenciement sans cause r\u00e9elle et s\u00e9rieuse<\/strong>&nbsp;ou d&rsquo;un licenciement nul selon les circonstances de la rupture.<\/p>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\">L&#8217;employeur sera alors condamn\u00e9 \u00e0 verser au salari\u00e9&nbsp;:<\/p>\n\n\n\n<ul class=\"is-style-arrow has-text-color wp-block-list\" style=\"color:#5b5b5b;font-size:20px\">\n<li>L\u2019indemnit\u00e9 compensatrice de pr\u00e9avis et les cong\u00e9s pay\u00e9s aff\u00e9rents<\/li>\n\n\n\n<li>L\u2019indemnit\u00e9 de licenciement l\u00e9gale ou conventionnelle<\/li>\n\n\n\n<li>les dommages int\u00e9r\u00eats dans la limite du plafond fix\u00e9 par le bar\u00e8me des ordonnances de 2017.<\/li>\n\n\n\n<li>L\u2019indemnit\u00e9 pour d\u00e9faut d\u2019information sur la portabilit\u00e9 de la pr\u00e9voyance<\/li>\n\n\n\n<li>Une indemnit\u00e9 pour un pr\u00e9judice distinct \u00e9ventuellement<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-color wp-block-paragraph\" style=\"color:#5b5b5b;font-size:20px\">Le tout peut \u00eatre soumis au paiement d\u2019int\u00e9r\u00eat l\u00e9gal et \u00e0 la capitalisation des int\u00e9r\u00eats.<\/p>\n","protected":false},"excerpt":{"rendered":"<p class=\"tx-excerpt\">Employeur&nbsp;?
